Oath of Office

Opposition to the Motion to Dismiss
This filing is called the Opposition to the Motion to Dismiss. It means that we are responding to the DOJ’s claim that the lawsuit should be dismissed, because everything is “fantastical” or “implausible.”
/
This Motion is important because this is where most TI’s lose, when they file a solo lawsuit. They don’t know how to respond to a Motion to Dismiss.
/
“Defendants’ Motion to Dismiss (“MTD”) compels dismissal because it refrains from mentioning –let alone discussing-- fundamental claims of the Second Amended Complaint such as the constitutional challenge to the placing of innocent civilians in the TSDB and the Writ of Mandamus sought against Defendants ordering them to fulfill the duties inherent to their position.”

OATH of Office
Defendants Wray, Kable, Garland, Mayorkas, & Wainstein - should have sworn this Oath. It is called Standard Form 61 (SF61), and it must be notarized.
https://www.opm.gov/forms/pdf_fill/sf61.pdf
“I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter. So help me God.”
What is the penalty for violating the Oath of Office?
There are pretty serious legal ramifications for violating the federal employees oath of office. You can be fined or imprisoned (see 18 USC 1918).
/
It is TJ’s opinion that DOJ may be violating their Oath of Office, due to a Conflict of Interest. Their first priority is to defend the Constitution, not the FBI.
/
In our Motion, the DOJ’s claims are filled with False Statements. And we identify each one. DOJ never specifies exactly where our claims are “fantastical.” It is really just HATE SPEECH from a government agency. Remember when the Democrats shouted “BELIEVE THE VICTIMS.”
/
Our response includes:
6 False Statements from DOJ
Glaring Omissions by DOJ
Use of Hate Speech by DOJ & Request to Strike
Federal Rules of Procedure, esp. the Mottley Rule
“Rule 12(b)(6) does not countenance...dismissals based on a judge’s disbelief of a complaint’s factual allegations” Bell Atlantic Corp. v. Twombly, 550 U.S. 544, 556 (2007) quoting Scheuer v. Rhodes, 416 U.S. 232, 236 (1974). A well-pleaded complaint may proceed even if it appears “that a recovery is very remote and unlikely.”

Interestingly, the DOJ missed their deadline to file on Monday night, May 1st. They have not responded to our Motion to Compel Discovery, filed on 8 April. This is very unusual…
